Terms of Service

Our binding agreement, founded on your absolute data sovereignty.

Terms of Service
Last updated: May 21, 2024

1. The DeepVault Philosophy: Your Data is Your Property

This is not just a service; it is a digital fortress built on the unshakeable principle of data sovereignty. Your data is, and always will be, your exclusive property. We provide the tools for you to secure and control it; we claim no rights, access, or ownership over your content whatsoever. These Terms are designed to legally enforce this core philosophy.

2. The Zero-Knowledge Contract

Our service is architected on a zero-knowledge model. This means that by cryptographic design, we, the service provider, have zero ability to decrypt, view, or access the content of your files. The encryption key is generated on your client device and is known only to you. You are the sole keyholder.

**Your Responsibility:** You acknowledge that this model places the responsibility for safeguarding your encryption key entirely on you. If you lose your key, your data is irretrievably lost. We have no 'backdoor,' no 'recovery key,' and no ability to reset your access. This is the necessary trade-off for absolute data privacy and sovereignty.

3. The 'Non-AI' Guarantee

We explicitly and contractually guarantee that we will **NEVER** scan, analyze, index, or use your data to train artificial intelligence models, for advertising, or for any purpose other than storing the encrypted data blob you have uploaded. Your data's privacy is absolute and not contingent on any setting.

4. User Conduct and Acceptable Use

While we cannot see the content of your files, you agree not to use DeepVault for any illegal activities, including but not limited to, storing or sharing content related to terrorism, child exploitation, or intellectual property infringement. You are solely responsible for the legality of the content you store. We will cooperate with lawful orders from authorized legal authorities, which may involve providing encrypted data blobs, but we cannot provide the content of those blobs.

5. Limitation of Liability

To the fullest extent permitted by law, DeepVault shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the loss of your encryption key and subsequent data inaccessibility; (iii) unauthorized access to or alteration of your transmissions or data (unless caused by a direct breach of our server security); (iv) any other matter relating to the service.

6. Termination

You can terminate your account at any time. Upon termination, all your encrypted data will be scheduled for permanent deletion from our servers. We reserve the right to suspend or terminate accounts that are in violation of these terms or are used for illegal activities.

7. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions.
